Important: Our Status as a Sober Living Home

Agape Sober Living is a sober living home in Costa Mesa, California — not a licensed treatment facility, healthcare provider, or covered entity under the Health Insurance Portability and Accountability Act (HIPAA).

As a sober living home, we are not legally required to comply with HIPAA regulations. However, we recognize the deeply personal nature of recovery, and we hold ourselves to high standards of privacy and confidentiality because it is the right thing to do for the people we serve.

Our Commitment to Protecting Your Information

Even though HIPAA does not apply to our operations, we are deeply committed to safeguarding the personal and health-related information of our residents, their families, and anyone who contacts us. We believe that privacy is essential to creating the safe, trusting environment our residents need to heal.

Our privacy practices include:

  • Confidential intake process. All personal information shared during admissions inquiries and the intake process is treated as confidential.
  • Limited information sharing. We do not share resident information with outside parties without the resident's knowledge and consent, except when required by law or in emergency situations involving safety.
  • Staff awareness. Our team understands the importance of discretion and is committed to maintaining confidentiality in all interactions.
  • Secure communications. We take reasonable steps to ensure that communications — including phone calls, emails, and form submissions — are handled securely.
  • Respectful environment. We foster a culture where residents feel safe sharing their experiences without fear of judgment or unauthorized disclosure.

Information We Protect

We treat the following types of information with care and confidentiality:

  • Personal identification information (name, contact details, date of birth).
  • Recovery history and background shared during the admissions or intake process.
  • Residency status and participation in house activities and meetings.
  • Any health-related information voluntarily shared by residents.
  • Drug and alcohol testing results.
  • Family and emergency contact information.

Our Treatment Provider Partnerships

Agape Sober Living partners with local treatment providers — including Partial Hospitalization Programs (PHP) and Intensive Outpatient Programs (IOP) — to support our residents' recovery journeys. These treatment providers are typically licensed healthcare entities that are subject to HIPAA regulations.

When we coordinate with treatment partners on behalf of a resident:

  • We only share information that is necessary and relevant to the resident's care coordination, and only with the resident's consent.
  • Our treatment partners maintain their own HIPAA-compliant privacy practices, including secure handling of Protected Health Information (PHI).
  • We encourage residents to review the privacy practices of their treatment providers directly.

When We May Disclose Information

While we default to confidentiality, there are limited circumstances where we may need to share information:

  • With resident consent. When a resident provides written or verbal authorization to share information with a family member, treatment provider, or other party.
  • Emergency situations. When there is an immediate threat to the health or safety of the resident or others.
  • Legal requirements. When required by law, court order, or legal process.
  • Care coordination. When sharing relevant information with treatment providers involved in the resident's care, with the resident's knowledge.

While HIPAA-specific rights do not formally apply to our sober living home, we respect and honor the following principles for all residents and inquiring individuals:

  • Right to ask questions. You can ask us at any time what information we hold about you and how it is used.
  • Right to request confidentiality. You may request specific privacy measures, and we will make every reasonable effort to accommodate them.
